Trademark Filing Suggests Collaboration Between Erin Andrews and Deion Sanders

Are Erin Andrews and Deion Sanders going into business together?

A recent trademark filing indicates this is happening.

On October 5, a joint filing was made by WEAR APPAREL, LLC (Erin Andrews’ company) and PRIME TIME ENTERPRISES, INC. (Deion Sanders’ company) for this logo:

The trademark filing indicates that these two companies have plans to use this logo for a brand of apparel. Specifically, the application claims the following products will be offered:

  • Blazers
  • Sleepwear
  • Suits
  • Trousers
  • Underwear
  • Bottoms as clothing
  • Caps being headwear
  • Jerseys being clothing
  • Neckties
  • Sports caps and hats
  • Sweat suits
  • Swim wear
  • Tops as clothing
  • Sports jerseys
  • Footwear
  • Hats
  • Hoodies
  • Socks
  • Clothing, namely shirts, pants and shorts
  • Outwear, namely, coats jackets, windbreakers, ponchos, gloves and mittens
  • Sweatshirts
  • Athletic jackets
  • Clothing jackets
  • Hooded sweatshirts
  • Short-sleeved or long-sleeved t-shirts
  • Stadium jackets
  • Jogging suits
  • Polo shirts
  • Sweat pants
  • Track suits

The only odd item about this filing is that it was made solely by Sanders’ legal team. Typically, a trademark filing such as this one would involve counsel from both parties to be listed in the trademark application.

Nevertheless, given that the application was filed, it will be interesting to see if an announcement about a collaboration is coming soon from either party.

The pair recently met up on August 31, 2023 when Andrews visited the University of Colorado to interview Sanders.

Update as of September 17, 2024

The trademark application filed by Deion Sanders and Erin Andrews was abandoned on September 17, 2024. The application was considered abandoned after the applicants did not respond to an office action.

The office action, which was filed on June, 3, 2024, was issued because of a Section 2(d): Likelihood of Confusion.

So, what trademark registration did the USPTO examining attorney cite in regards to the Likelihood of Confusion refusal?

A registration owned by one of the owners for this trademark application, Wear Apparel, LLC (Erin Andrews’ company). The registration is to protect “WEAR BY ERIN ANDREWS” for use with clothing.

In the office action, the examining attorney also noted that there are 7 prior-filed applications that would also cause a Likelihood of Confusion refusal. Six of these applications are owned by Prime Time Enterprises, Inc (Deion Sanders’ company) and one is owned by Wear Apparel, LLC.
