Trump Organization Files New ‘Trump 250’ Trademark Applications Ahead of America’s 250th Birthday

The Trump Organization has filed a series of new trademark applications tied to the upcoming 250th anniversary of the United States. 

The filings, submitted by DTTM Operations LLC, the entity that manages and owns Trump Org’s trademarks, seek protection for ‘Trump 250’ along with several related designs.

In total, the company filed five new applications late last week, including:

1. Serial #: 99687654

TRUMP 250

2. Serial #: 99687730

3. Serial #: 99688018

4. Serial #: 99687949

5. Serial #: 99688053

All of the filings are directed at a wide range of merchandise products, including clothing, underwear, ties, footwear, golf balls, drinkware, plates, tote bags, and stickers.

The filings suggest the Trump Organization may be preparing to sell or license branded products tied to the nation’s upcoming 250th anniversary, which will be celebrated on July 4, 2026.

Trump Org filed the applications on an “intent-to-use” basis, meaning the trademarks are not yet being used in commerce, but the company has a bona fide intention to use or license the trademarks in the future.

Trademark filings on an intent-to-use basis are common when companies want to reserve rights to a brand before launching products.

The applications will now enter the normal USPTO review process, which typically takes several months before an examiner reviews the filings.

Can ‘Trump 250’ coexist with ‘America 250’?

From my perspective as a trademark attorney, these filings raise a potentially interesting issue involving another entity that is already actively protecting similar branding tied to the country’s 250th anniversary.

The United States Semiquincentennial Commission, the congressionally created body overseeing the celebration, has already filed its own trademark applications for ‘America 250.’

Those filings include logos where “America” appears in smaller text with “250” prominently displayed beneath it, a format that bears some visual resemblance to the newly filed ‘Trump 250’ designs.

The commission has also been actively enforcing its marks.

For example, it has threatened to oppose a trademark application for ‘USA 250.’ At the same time, it has been licensing the ‘America 250’ branding to companies that want to place the logo on merchandise tied to the anniversary.

Because of that enforcement and licensing activity, one question that naturally arises is whether the commission could attempt to challenge the Trump filings if it believes consumers might see the marks as related.

That said, this question won’t likely be answered anytime soon.

The ‘Trump 250’ applications will likely take months to be examined by the USPTO. Only after they are examined would the United States Semiquincentennial Commission have an opportunity to oppose the filings.

Unprecedented history of these trademark filings

Intent-to-use trademark filings, such as the ‘Trump 250’ marks, are a signal that a company is working behind the scenes to bring products to market.

In this case, Trump Org appears to be positioning itself to participate in the wave of commemorative merchandise likely to accompany the nation’s 250th anniversary. By filing trademark applications, the company is seeking to secure exclusive rights to the ‘Trump 250’ brand and its associated logo.

These trademark filings come on the heels of the Trump Org filing trademarks for ‘President Donald J. Trump International Airport.’

As I noted in a blog about those Airport filings, it was unprecedented for a President’s private company to own the trademark for the honorary naming of a public institution, such as an Airport.

These filings are also unprecedented.

Many Presidents have overseen large anniversaries or events in United States history.

None of them, except for Trump, has filed trademarks and attempted to sell merchandise through a private company associated with those events.
