The Washington Post Speaks with Josh Gerben About the Legal Risk of Selling Merchandise Related to the Trump Assassination Attempt
Since the attempt on Donald Trump’s life, thousands of listings for merchandise have appeared online. Most of this merchandise uses pictures from the assassination attempt, which could lead to legal ramifications for the sellers.
The Washington Post spoke to Josh Gerben regarding the legal issues sellers could face by using this imagery.
“Depending on the image, and who took it, and the resources of the person who took it, you could definitely see copyright takedown claims come out,” Gerben said.
The Washington D.C.-based attorney went on to say that Trump’s legal team could also go after sellers for profiting from his image, however, “The amount of effort it would take to get all of this taken down, it’s probably not worth the effort as opposed to selling their own.”
