Josh Gerben Quoted by The Washington Post About Redskins Knockoffs

Martin McCaulay has submitted multiple trademark applications for names he thinks the Washington Redskins might use in the future in the hopes that they will come to him with a large payout in exchange for his trademark rights.

Josh Gerben was quoted by the Washington Post regarding the strategy of trademark squatting:

“You can’t just decide, ‘Oh, I think this will be a really good name for the Redskins,’ file a trademark application and then hold them hostage,”

“He couldn’t enforce the trademarks unless he can back them up with business records that show he has legitimate and ongoing sales,” […] “You can’t just sell one shirt a year on a Web site.”

“I wouldn’t want to be the one to try to defend this in court,”
