CNBC and Josh Gerben Discuss Tiger Woods’ Federal Trademark Lawsuit

The trademark dispute between the Tiger Woods and TaylorMade apparel company Sun Day Red and Tigeraire has now moved to federal court.

CNBC and Josh Gerben discussed the lawsuit, which accuses Tigeraire of attempting to capitalize off of the popularity of the Sun Day Red brand. 

Josh Gerben, a trademark attorney, described the lawsuit an “aggressive response” to the ongoing trademark dispute. He notes that when a case is brought to federal court, it typically makes the legal matter much more expensive for a smaller company like Tigeraire.

“A lot of time these cases favor the party with the resources to litigate, and that can make it a challenge,” Gerben said.
