CBS Sports Quotes Josh Gerben About OSU’s Challenge to ‘BUCKEYE TEARS’ Trademark

Ohio State University filed a legal challenge to Michigan-based restaurant’s trademark to protect ‘BUCKEYE TEARS’ for beer and liquor.

CBS quoted Josh Gerben’s legal analysis of the case. 

It’s going to be hard for Ohio State to prove consumer confusion, as it’s unlikely consumers will think the University is associated with a product named ‘BUCKEYE TEARS.’

However, if the restaurant release a product that uses OSU’s colors or logos, the University’s case could grow stronger.
