Inc and Josh Gerben Discuss Lawsuit Filed Against Steakhouse Owned by Patrick Mahomes and Jason Kelce

In February, Travis Kelce and Patrick Mahomes were sued for trademark infringement over the name of their Kansas City steakhouse.

Josh Gerben explains the basis of the lawsuit with Inc.

Trademark attorney Josh Gerben of Gerben IP, who has followed the case since it was filed told Inc. that the dispute ultimately comes down to timing. 1587 Sneakers didn’t file trademarks for its name “1587” or its logo until October 2025, even though it because selling footwear in April 2023.

The sneaker company’s filings were made after the “1587 Prime” trademark was filed in December 2023 and the restaurant was already opened.

That gap matters, Gerben says, because “the day you’re filing the application is your federal priority date.”

Gerben also notes that as the case moves forward, the court will likely have to dig into questions like: What kind of sales did 1587 Sneakers have before the restaurant filed its application? How extensive were those sales? And how far did the company’s rights under U.S. law actually extend by the time the restaurant filed its own application?
