Domain Name Dispute Resolution
As the online marketplace has grown, domain names have become digital storefronts for brands. If another party registers a domain that incorporates your trademark, they may attempt to profit off your brand’s reputation, a practice known as cybersquatting.
If this happens, you have options. At Gerben IP, we help trademark owners navigate domain name disputes using the Uniform Domain-Name Dispute Resolution Policy (UDRP), a powerful tool for reclaiming domains without going to court.
What is a UDRP dispute?
The UDRP is a global arbitration process established by ICANN (the Internet Corporation for Assigned Names and Numbers) to resolve disputes involving domain names that infringe on trademark rights. Most disputes are filed through the World Intellectual Property Organization (WIPO).
UDRP proceedings are faster and more cost-effective than traditional litigation, with most cases resolved within a few months.
You may be able to recover a domain name if:
- The domain is confusingly similar to your registered trademark.
- The current domain owner has no legitimate rights to the domain.
- The domain was registered and is being used in bad faith, often to extort money, divert web traffic, or damage your reputation.
While a trademark registration is not required to file a UDRP complaint, having one significantly strengthens your case. It provides a clear legal basis for enforcement and improves your changes of a successful outcome.
What the UDRP process looks like
Our experienced attorneys will guide you through every step:
Evaluating Your Claim
We’ll assess your trademark rights and the strength of your case.
Preparing the Complaint
We draft and submit the complaint to the appropriate arbitration provider (such as WIPO).
Managing Responses
The domain holder has 20 days to respond. Once they do, we will review their defense and prepare any needed rebuttals.
Decision Issued
A panel reviews the case and issues a decision. If successful, the domain is transferred to you.
